Terms of Service

1. Acceptance of Terms

By accessing or using SerpHive ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use SerpHive. These Terms constitute a legally binding agreement between you and SerpHive.

2. Description of Service

SerpHive is a Search Visibility Command Center that provides tools for SEO, Answer Engine Optimization (AEO), Generative Engine Optimization (GEO), LLM Optimization, keyword tracking, technical audits, GeoAsset management, and client reporting. Access to features depends on your subscription plan.

3. Subscriptions, Trials, and Billing

SerpHive offers subscription plans billed monthly or annually. A 30-day free trial may be offered at our discretion. A valid payment method is required to start a trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will activate and you will be charged. You may cancel at any time before the trial ends without being charged. Access continues until the end of the current billing period. We reserve the right to change pricing with reasonable notice.

4. Intellectual Property and Ownership

SerpHive and all of its content, features, functionality, design, code, algorithms, user interface elements, visual designs, branding, reports, logic, and methodology are owned exclusively by SerpHive and are protected by copyright, trademark, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use SerpHive solely for your own internal business purposes during an active subscription. This license does not include any right to:

• Copy, reproduce, or replicate any part of SerpHive's interface, design, or functionality
• Reverse-engineer, decompile, disassemble, or attempt to derive source code from the Platform
• Scrape, crawl, or systematically extract data from the Platform using automated tools
• Recreate, clone, or build a competing product based on SerpHive
• Resell, sublicense, or redistribute access to the Platform or any part thereof
• Use SerpHive's UI, architecture, workflows, or logic to develop a competing service
• Share, distribute, or transfer your login credentials or paid access to unauthorized users

Any unauthorized use of SerpHive's intellectual property will result in immediate account termination and may result in legal action.

5. Prohibited Uses

You agree not to use SerpHive to:

• Violate any applicable laws or regulations
• Engage in unauthorized data collection, scraping, or harvesting
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Use automated scripts, bots, or tools to abuse the Platform
• Perform excessive API requests that degrade service for other users
• Circumvent authentication, subscription, or access controls
• Upload malicious code, viruses, or harmful content
• Impersonate other users or misrepresent your identity
• Use trial accounts repeatedly to avoid paying for access

6. Account Security

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access or breach. SerpHive is not liable for any loss or damage arising from unauthorized account access caused by your failure to secure your credentials.

7. Data and Privacy

Your use of SerpHive is subject to our Privacy Policy. We collect and process data as described therein. You retain ownership of your own data (projects, keywords, reports) but grant us a license to host and process it to provide the service. We do not sell your data to third parties.

8. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, suspected fraud, abuse, or any activity that harms the Platform or other users. Upon termination, your access will cease immediately. We may retain your data for up to 30 days after termination before deletion.

9. Disclaimers and Limitation of Liability

SerpHive is provided "as is" without warranties of any kind. We do not guarantee specific SEO results, rankings, or business outcomes. To the fullest extent permitted by law, SerpHive shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform.

10. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of SerpHive after changes take effect constitutes acceptance of the updated Terms.
